1. Introduction and Acceptance of Terms

Welcome to the Tucci’s App! These Terms of Service (“Terms”) are a legal agreement between you (“you” or “the user”) and Tucci’s, part of CLB Restaurants, governing your access to and use of the Tucci’s mobile application and its features (the “App”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

We’ve written these Terms to be as clear as possible while covering the necessary legal protections. By using our App, you agree to follow the rules outlined here. 2. User Accounts and Eligibility

2.1 Account Creation and Requirements

To access most features of the Tucci’s App, you must create a user account. When creating an account, you agree to:

  • Provide accurate, current, and complete information.
  • Maintain and update your information to keep it accurate.
  • Use a valid email address and phone number.
  • Choose a secure password and keep it confidential.

You are responsible for all activities that occur under your account, including any unauthorized use.

2.2 Age Requirements and Restrictions

  • General Use: The App is intended for users 13 years of age and older.
  • Adult Features: Users must be 18 or older to create an account.
  • Alcohol Purchases: Wine orders and alcohol-related services require users to be 21 or older.
  • Age Verification: By using alcohol-related features, you represent that you are 21 or older and will provide valid ID upon pickup.

If you are under 18, you may only use the App with parental or guardian supervision. We reserve the right to refuse service to anyone who cannot provide proper age verification.

2.3 Account Security

You are responsible for:

  • Keeping your login credentials secure and confidential.
  • Immediately changing your password if you suspect unauthorized access.
  • Logging out from shared devices.
  • Notifying us immediately of any security breaches.

2.4 Account Termination

  • By You: You may delete your account at any time through the App settings or by contacting us.
  • By Us: We may suspend or terminate your account if you violate these Terms, engage in illegal activities, or misuse the App.
  • Effect of Termination: Account termination will disable access to App features requiring login.

3. Permitted Use and Prohibited Activities

3.1 Permitted Use

We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes related to Tucci’s services.

3.2 Prohibited Activities

You agree not to:

  • Illegal Use: Use the App for any unlawful purpose or violate any laws.
  • Harmful Behavior: Harass, threaten, or harm others through the App.
  • Unauthorized Access: Attempt to hack, reverse engineer, or access restricted areas.
  • Spam or Abuse: Send unsolicited communications or abuse our services.
  • False Information: Provide false or misleading information.
  • Fraudulent Activities: Make fraudulent orders, reservations, or payments.
  • Loyalty Fraud: Create multiple accounts, share loyalty codes, or abuse the loyalty system.
  • Data Scraping: Collect data from the App using automated means.
  • Impersonation: Impersonate others or create fake accounts.
  • Commercial Use: Use the App for commercial purposes without permission.
  • Disruption: Interfere with App functionality or security measures.

Violation of these rules may result in account suspension or termination and legal action.


4. Restaurant Services and Features

4.1 Loyalty Program

Program Overview:

  • The Tucci’s loyalty program allows you to earn points on qualifying purchases and redeem them for rewards.
  • Enrollment is free and voluntary.
  • You must be 18 or older to enroll in the loyalty program.
  • One loyalty account per person; duplicate accounts may be merged or terminated.

Point Earning:

  • Earn 1 point per $1 spent on food and non-alcoholic beverages.
  • Points are NOT earned on alcohol, tax, or gratuity.
  • Points are calculated on the subtotal before discounts, tax, and tip.
  • Points are awarded automatically when you provide your loyalty code at checkout.
  • Points may take up to 24 hours to appear in your account.

Point Redemption:

  • Redeem points for rewards as specified in the reward catalog.
  • Rewards expire 2 hours after redemption.
  • You must be present at Tucci’s to redeem rewards.
  • Rewards cannot be transferred, sold, or exchanged for cash.
  • We reserve the right to limit reward availability.

Loyalty Code:

  • You receive a unique 4-digit loyalty code upon enrollment.
  • Provide this code to your server when paying to earn points.
  • Keep your code confidential; you are responsible for its use.
  • We may change your code for security reasons.

Account Management:

  • You can view your points balance and transaction history in the App.
  • Points expire after 12 months of account inactivity.
  • We may adjust points for errors, fraud, or policy violations.
  • Account termination forfeits all unredeemed points.

Program Rules:

  • Points cannot be earned on gift card purchases or reloads.
  • We reserve the right to modify the program terms with notice.
  • Fraudulent activity may result in account termination.
  • The program is subject to availability and may be discontinued.

4.2 Menus and Information

  • Menu items, prices, and availability are subject to change without notice.
  • We strive for accuracy but cannot guarantee all information is current.
  • Some items may be unavailable due to seasonal or supply issues.
  • Contact the restaurant directly for specific questions about availability.

4.3 Takeout Orders

Order Process:

  • Place orders through the App for pickup at Tucci’s.
  • Orders are transmitted to our kitchen for preparation.
  • You will receive confirmation of your order.

Payment:

  • Currently, all payments are made in-person upon pickup.
  • We accept cash, credit cards, and other standard payment methods.
  • Do not provide payment information through the App.
  • Future payment features will be announced with updated terms.

Order Management:

  • Changes or cancellations must be requested by calling (614) 792-3466.
  • We may not accommodate changes if preparation has begun.
  • We reserve the right to cancel orders due to stock issues or suspected fraud.

Quality and Allergies:

  • Please specify allergies or dietary restrictions in order notes.
  • Our kitchen is not allergen-free; cross-contamination is possible.
  • We are not liable for allergic reactions if information wasn’t provided.

No-Show Policy:

  • Repeated no-shows may result in pre-payment requirements.
  • We reserve the right to refuse future orders from problematic users.

4.4 Wine Orders and Alcohol Sales

Age Verification:

  • Wine orders require users to be 21 or older.
  • Valid government-issued ID required for pickup.
  • We reserve the right to refuse alcohol sales to anyone.

Payment Processing:

  • Wine orders are processed through Stripe payment system.
  • Credit card information is handled securely by Stripe.
  • We do not store payment card information.

Delivery and Pickup:

  • Wine orders are available for pickup only.
  • Delivery may be available for qualifying orders (20-mile radius, $100+ orders).
  • Delivery fees apply as specified in the App.

Legal Compliance:

  • All alcohol sales comply with local, state, and federal laws.
  • We reserve the right to refuse service to intoxicated individuals.
  • Alcohol sales are subject to availability and legal restrictions.

4.5 Reservations

OpenTable Integration:

  • Reservations are processed through OpenTable’s system.
  • Subject to OpenTable’s terms of service and privacy policy.
  • We honor all confirmed reservations made through the App.

Reservation Terms:

  • Provide accurate party size and contact information.
  • Arrive on time for your reservation.
  • Cancel reservations as early as possible if unable to attend.
  • We may release tables for no-shows after 15 minutes.

Modifications:

  • Changes can be made through the App or by calling the restaurant.
  • Special requests are subject to availability.
  • We cannot guarantee specific tables or seating areas.

4.6 Events and Private Dining

Event Information:

  • Event details are subject to change.
  • Limited-seating events may require advance booking.
  • Some events may have separate terms and pricing.

Private Dining Requests:

  • Requests are processed through the PerfectVenue platform.
  • Submitting a request does not guarantee availability.
  • Our events team will follow up within 1–2 business days.
  • Final arrangements may require separate contracts and deposits.

Event Cancellations:

  • We reserve the right to cancel or modify events.
  • Refunds will be provided for canceled events.
  • We will notify attendees of any changes.

5. Third-Party Services and Integrations

5.1 Third-Party Services

Our App integrates with several third-party services:

Supabase (Data Storage):

  • Provides secure database and authentication services.
  • Subject to Supabase’s terms of service and privacy policy.
  • Handles user account data and app information.

Resend (Email Services):

  • Delivers transactional and marketing emails.
  • Subject to Resend’s terms of service and privacy policy.
  • Processes email addresses and message content.

Stripe (Payment Processing):

  • Processes payments for wine orders and other purchases.
  • Subject to Stripe’s terms of service and privacy policy.
  • Handles payment card information securely.

OpenTable (Reservations):

  • Facilitates restaurant reservations.
  • Subject to OpenTable’s terms of service and privacy policy.
  • Manages reservation data and confirmations.

PerfectVenue (Event Management):

  • Handles private dining and event requests.
  • Subject to PerfectVenue’s terms of service and privacy policy.
  • Processes event inquiry data.

5.2 Third-Party Disclaimers

  • We are not responsible for third-party service performance or issues.
  • Third-party services have their own terms and privacy policies.
  • We recommend reviewing third-party terms before using their features.
  • We may assist with third-party issues but cannot guarantee resolution.

5.3 Social Media and External Links

  • The App may contain links to social media platforms and external websites.
  • We are not responsible for content on external sites.
  • Clicking external links is at your own risk.
  • External sites have their own terms and privacy policies.

6. Intellectual Property Rights

6.1 Our Content

All content in the App, including text, images, graphics, logos, menus, and software code, is owned by Tucci’s/CLB Restaurants or our licensors and protected by copyright, trademark, and other intellectual property laws.

6.2 License to You

We grant you a limited, non-exclusive, non-transferable license to:

  • Use the App for personal, non-commercial purposes.
  • View content for legitimate restaurant service use.
  • Access features as intended by the App.

6.3 Restrictions

You may not:

  • Copy, reproduce, or distribute App content.
  • Create derivative works from our content.
  • Use our trademarks or logos without permission.
  • Reverse engineer or extract source code.
  • Use content for commercial purposes.

6.4 User-Generated Content

  • Any content you submit (feedback, reviews, photos) grants us a license to use it.
  • You retain ownership of your content but grant us broad usage rights.
  • We may use your content for marketing, improvement, or other business purposes.

7. Disclaimers and Warranties

7.1 App Provided “As Is”

The App and all services are provided “as is” and “as available” without warranties of any kind. We disclaim all warranties, express or implied, including:

  • Merchantability and fitness for a particular purpose.
  • Accuracy, completeness, or reliability of information.
  • Uninterrupted or error-free operation.
  • Security or freedom from viruses.

7.2 Information Accuracy

  • Menu items, prices, and availability may change without notice.
  • We strive for accuracy but cannot guarantee all information is current.

  • We are not liable for outdated or inaccurate information.

7.3 Third-Party Services

  • We do not guarantee third-party service performance.
  • Third-party downtime or issues are beyond our control.
  • We will assist with third-party problems but cannot guarantee resolution.

7.4 Device and Connectivity

  • You are responsible for compatible devices and internet connectivity.
  • We are not liable for device issues or connectivity problems.
  • App performance may vary based on device capabilities.

8. Limitation of Liability

8.1 General Limitation

To the maximum extent permitted by law, Tucci’s and CLB Restaurants shall not be liable for:

  • Indirect, incidental, special, or consequential damages.
  • Loss of profits, data, or other intangibles.
  • Emotional distress or inconvenience.
  • Damages exceeding $50 or amounts paid for App use.

8.2 Specific Exclusions

We are not liable for:

  • Device damage or data loss from App use.
  • Third-party service issues or failures.
  • User errors or misuse of App features.
  • Acts of God, natural disasters, or other force majeure events.

8.3 Legal Compliance

Some jurisdictions may not allow liability limitations, so these restrictions may not apply to you in full. Where prohibited by law, our liability will be limited to the maximum extent permitted.


9. Indemnification

You agree to defend, indemnify, and hold harmless Tucci’s, CLB Restaurants, and our officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorneys’ fees) arising from:

  • Your use or misuse of the App.
  • Your violation of these Terms.
  • Your violation of any laws or third-party rights.
  • Your content or communications through the App.

10. Dispute Resolution

10.1 Governing Law

These Terms are governed by the laws of Ohio, USA, without regard to conflict of law principles.

10.2 Jurisdiction

Any disputes will be resolved in state or federal courts located in Franklin County, Ohio. You consent to the exclusive jurisdiction of these courts.

10.3 Informal Resolution

Before filing any legal claim, you agree to contact us at community@clbrestaurants.com to attempt informal resolution. We will make good-faith efforts to resolve disputes amicably.

10.4 Arbitration

For disputes involving amounts under $10,000, either party may elect to resolve the matter through binding arbitration under the rules of the American Arbitration Association.

10.5 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

10.6 Statute of Limitations

Any claims must be filed within one year of the event giving rise to the claim.


11. Privacy and Data Protection

11.1 Privacy Policy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using the App, you consent to our Privacy Policy.

We collect information necessary to provide our services, including:

12. Age Verification and Alcohol Sales

  • All alcohol sales require users to be 21 or older.
  • We verify age through government-issued ID at pickup.
  • We reserve the right to refuse alcohol sales to anyone.

12.2 Responsible Service

  • We will not serve alcohol to intoxicated individuals.
  • We comply with all local, state, and federal alcohol laws.
  • We reserve the right to refuse service for any reason.

12.3 Legal Compliance

  • All alcohol sales comply with applicable regulations.
  • We maintain records as required by law.
  • We cooperate with law enforcement when necessary.

13. Changes to Terms

13.1 Updates

We may update these Terms periodically to reflect:

  • Changes in our services or features.
  • Legal or regulatory requirements.
  • Improvements to user experience.

13.2 Notification

We will notify you of material changes through:

  • In-app notifications.
  • Email notifications (if we have your email).
  • Updated “Last Updated” date in the Terms.

13.3 Continued Use

Your continued use of the App after changes constitutes acceptance of the new Terms. If you disagree with changes, you must stop using the App and delete your account.

16. Miscellaneous Provisions

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Tucci’s regarding the App.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Our failure to enforce any provision does not constitute a waiver of our rights.

16.4 Assignment

You may not assign these Terms without our consent. We may assign these Terms in connection with business transfers.

16.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our control.
